Laut.fm : das Mitmachradio
Nach laut.de - der Musik-Plattform aus Deutschland - gibt es jetzt auch laut.fm
Es handelt sich dabei um ein Mitmachradio, auf dem man sein eigenes Musikradioprogramm zusammenstellen kann. Entweder werden die eigenen Songs ge-uploaded oder man greift auf die Songdatenbank von laut.fm zurück. Das Coole an der ganzen Sache: Man kann seinen eigenen Radiostream auf der eigenen Homepage einbauen (oder diejenigen anderer "Radioproduzenten"). Es scheint sich dabei lediglich um Musik zu drehen. Interessant wäre natürlich die Generierung von redaktionellen Beiträgen zu musikrelevanten oder anderen Themen. Vielleicht gibts das ja auch bereits.
Wie es rechtlich aussieht, weiss ich gerade nicht. Dürfen eigene (also selbstproduzierte) Songs in die Datenbank gespiesen werden? Verliert man dann die Nutzerrechte? Darf ich meine legal oder illegal erworbenen Songfiles einfach so hinzufügen? Bezahlt dann laut.fm die Gebühren? Wer mehr weiss, darf gerne antworten ;o)

So, hatte noch ein wenig Zeit gefunden, mich mit den AGB's auseinanderzusetzen. Nicht ganz alle Punkte entsprechen dem Community-Gedanken:
- Die zum Betrieb eines solchen eigenen Internetradios erforderlichen und anfallenden Streaminggebühren, GEMA- und GVL-Lizenzen werden durch den Anbieter entrichtet, hierzu wurden entsprechende vertragliche Vereinbarungen mit den entsprechenden Gesellschaften geschlossen,
- Als Gegenleistung wird dem Anbieter die Möglichkeit eingeräumt in den Radiostreams und -Playern Werbung zu schalten. Über Art und Umfang wird das Mitglied regelmäßig hinreichend informiert.
- Die vom Mitglied veröffentlichte Inhalte sind eigene Inhalte des Mitgliedes. Sofern das Mitglied eigene Musikdateien in den Dienst hochlädt, steht es selbst dafür ein, jegliche hierfür erforderliche Rechte zu besitzen.
- Der Anbieter stellt lediglich das System und den Speicherplatz zur Verfügung. Die Verantwortung für sämtliche Inhalte, die von Mitgliedern über den Dienst des Anbieters übermittelt und veröffentlicht werden trägt ausschließlich das anbietende Mitglied.
- Das Mitglied überträgt dem Anbieter ein örtlich zeitlich unbeschränktes Nutzungsrecht an den vom jeweiligen Mitglied auf dem Dienst öffentlich zugänglich gemachten oder gespeicherten Inhalten. Das Mitglied garantiert, dass durch diese Inhalte keine Rechte Dritter verletzt werden.
- Das Mitglied darf keine unautorisierten Musikaufnahmen übertragen; dazu zählen ohne Ausnahme sog. Bootlegs (unautorisierte Konzertmitschnitte) und Aufnahmen, die im Land, in dem das Mitglied seinen Sitz hat, noch nicht veröffentlicht worden sind. Das Mitglied darf die Musikaufnahmen nicht re-mixen oder in anderer Weise verändern, sodass die übertragenen Musikaufnahmen sich von den Originalaufnahmen unterscheiden.
Ok, so weit klar. Nicht ganz sicher bin ich mir darüber, ob ich im Besitz "jeglicher hierfür erforderlichen Rechte" einer gekauften CD bin, um sie (ohne Gewinnorientierung) über laut.fm ausstrahlen zu dürfen. Wohl eher nicht, bin aber kein Jurist...
Nicht ganz ok finde ich das Übertragen eines unbeschränkten Nutzungsrechts hochgeladener Inhalte an den Anbieter. Hatten wir das Problem nicht schon mal beim online Photoshop-Angebot??? (Wurde auch hier, hier, hier, hier und hier thematisiert).

das würde dann also heissen, dass man wirklich nur seine eignen, also wirklich selbst produzierten Tracks hochladen kann. Irgendwie schade...Würde mich also noch interessieren, wie gross die Song-Datenbank von laut.fm ist. Zu kleine macht keinen Spass.

Das Überlassen von Nutzungsrechten ist, soweit ich weiß, normal und auch bei anderen Diensten wie Youtube zu finden. Man muss dem Anbieter ja erlauben die erstellten Inhalte verbreiten zu dürfen damit so etwas funktioniert. Allerdings werden die Nutzungsrechte in der Regel nur eingeschränkt überlassen, also nur so weit, wie es für die Durchführung des Angebots notwendig ist und die Überlassung endet z. B. wenn man seinen Account löscht. Was mich ein bisschen stutzig macht ist das "zeitlich unbeschränktes". Vermutlich geht es darum, dass einmal in den Laut.fm-Titel-Pool hochgeladene Songs auch nach Löschen des eigenen Accounts für die anderen User (und deren playlists) erhalten bleiben sollen. Aber auch das fände ich nicht unbedeutend. Darüber sollte man sich im Klaren sein, wenn man dort Songs hochlädt.
